Police investigators found that force was used by Lisa Mearkle without legal reason.
She steered her vehicle and tried to pull on the 59-year old David Kassick over. Rather than halting, Kassick drove away and blown off her flashing lights.
Mearkle gave chase as Kassick pulled into a drive before fleeing on foot to the backyard of the house and drove to Grandview Road. He was followed by Mearkle to an embankment in the right or left side of the house, where he was tasered by her. Kassick fell to the snow-covered ground with his back facing the policeman as he was tasered by her a second time.
Mearkle ordered him to place his hands upward and was not capable to see Kassick’s left hand.
With his left hand, Kassick attempted to pull both taser probes in his back out.
Mearkle took out her pistol with her right hand and shot Kassick in the back twice.
Kassick had a long history of alcohol abuse, as well as a syringe was discovered in the scene. He had substances and booze in his system in the time of his passing.
